Private Investigators Act (CA)
Through this act California Department of Consumer Affairs (DCA) is authorized to ask for a private investigators license from an investigative firm or an individual investigator who undertakes investigative service of any suspected misconduct or reliability of a new employee for the benefit of an employer. A violation of this law by any firm or individual would land it in jail for one year or a fine of $5000 or both. However the actual employee of the concerned employer or an attorney at law does not come under the purview of this restriction.
Consultant Investigation
Without a private investigator’s license the Human Resource Consultants are also not allowed to undertake an investigation on their own. If this rule is violated then they may be charged a fine by the DCA. However this law does not subject any employer to a fine if they take up an HR consultant without this license. An employer may face a litigation problem if an HR consultant without a license undertakes an investigation on an employee and terminates him for misconduct and the terminated employee challenges the validity of the investigation.
